MEXICO CITY — A federal judge has approved the sale of Viagra, a popular over-the-counter medication for erectile dysfunction, as a temporary temporary stay to allow the pharmaceutical company to continue to manufacture and sell the drug.
The drugmaker was able to pay out-of-court settlements in the U. S. Justice Department for several cases and pay out-of-court payments to the pharmaceutical giant for marketing it.
“MEXICO was pleased to find that the Food and Drug Administration (FDA) has approved the sale of Viagra, and it was also pleased to have a preliminary hearing scheduled to be held in October 2028,” the judge wrote in his order. “The FDA is committed to ensuring that all drug manufacturers meet the requirements for obtaining a preliminary hearing for pharmaceutical manufacturers to file a motion seeking the approval of a generic version of Pfizer’s Viagra.
“It is our hope that this preliminary hearing will be held in November 2028, so that the FDA can determine whether the generic version of Pfizer’s Viagra will be effective and whether the drug has sufficient safety and efficacy for a person to have a legitimate medical interest in the use of the drug.”
The order was approved Friday by a panel of judges in the United States District Court for the Eastern District of New York, sitting in New York. The drugmaker was also approved to pay out-of-court payments to the pharmaceutical company and to the state of California for marketing Viagra.
“We are pleased with the ruling,” said David Zilbowski, M. D., a medical assistant professor of medicine at the Yale School of Medicine, in a statement. “It confirms that a manufacturer can make money from a drug without paying for the medication, and that the FDA is committed to the safety and efficacy of this drug in the U. It also confirms that it is a legitimate drug and that it has a safe and effective use in the U. The U. District Court for the Eastern District of New York, which has exclusive jurisdiction over this case, is also in favor of maintaining the FDA’s ability to monitor the safety and efficacy of drugs.
“We are also pleased to see the FDA move its order to a final order and pay out-of-court payments to Pfizer,” said David L. Bixler, M. D., chairman of the FDA’s Office of Generic Drugs. “We are grateful for the guidance of the FDA, and we are hopeful that this decision will be a positive step toward bringing affordable generic drugs to market.”
The company filed a brief in the case on behalf of its members and agreed to pay out-of-court payments to Pfizer, the federal agency that represents pharmaceutical companies.
The company said it is working to secure the payment of payments that it expects to receive from the court order.
